The timing of a wrongful death claim is really important. That’s for two reasons: for part of a wrongful death claim, you have an estate that has certain rights, and you have hospitals that have certain rights, in fact, you even have insurers that have certain rights. On the other hand, you have heirs that have certain rights, so you need to figure out who your potential clients are going to be, you need to make sure that you have all of the clients who are being represented, and you need to make sure that you’ve juggled those interests in a way that you’re doing the best for each of your potential clients.
The best time is when you’re capable, emotionally and cognitively, to deal with the fact that you’ve lost someone that you’ve loved. But when you come to the point that you realize that somebody has caused you this tremendous wrong, then it’s time to get your family together to speak to your family about who those represented are going to be, and then come to a lawyer with the type of experience that we have in representing these matters.
