Injured workers are eligible to receive benefits by filing Workers’ compensation claims. Every employer is required to carry insurance to cover injuries and illnesses caused by work conditions. These benefits cover lost wages, medical treatment and rehabilitation, job retraining, and may include permanent disability payments.

Types of Injuries Covered Under Workers’ Compensation Law

There is no list of workplace injuries that are automatically covered or denied coverage as workers’ compensation claims. The key to getting your claim approved is showing the connection between the workplace injuries and the scope of the job duties. Workplace injuries can include:

  • Repetitive motion injuries – these can include something like soft tissue damage to an area from repeatedly lifting heavy objects in the same way, or a condition such as carpal tunnel syndrome
  • Traumatic physical injuries – these include workplace injuries involving slip and falls, forklift accidents, explosions, etc.
  • Occupational diseases – these are caused by hazardous conditions and could include something like black lung disease for coal miners, or asbestosis for an insulation installer. The illness should be one that is not common to everyday life, but can be caused by conditions in the work atmosphere.

What Should You Do if You Are Injured at Work?

A medical professional will not only treat your injuries but can also document them. After receiving treatment injured workers should make sure the employer is notified that the workplace injuries occurred, and that medical treatment has been received.

The injury or diagnosis must be presented to your employer in writing. Your employer should have a form to fill out. If you require medical treatment, let the healthcare provider know that you will be filing a claim. They will be required to fill out a form and mail it within three business days of initial treatment.
